Revisiting Corporate Criminal Liability: A Legal Analysis of Recent Criminal Law Reforms and Economic Legislations in India

Abstract

The evolution of corporate criminal liability in India shows how globalisation, economic liberalization, and the push for tough regulatory oversight. This paper takes a look at how the jurisprudence of corporate criminal liability has evolved under the new laws in criminal justice system. With LPG reforms more MNC are spreading their wings in India and therefore our goal is to strike a balance between encouraging business growth and keeping companies accountable. In this paper we have analysed the idea of corporate criminal liability and shift in the interpretation of the same overtime. Histrionically the corporate law function of the basis of the focus on traditional principles of fault based liability, but as economy grows the regulatory compliance, corporate governance, transparency, accountability takes more important in maintaining oraganisational integrity. The paper further analyses recent legislative measures that streamline compliance mechanisms, reduce procedural burdens, and foster a stable and conducive business climate.
